Terms of Service

1. Acceptance of Terms
By accessing or using Crit-Fumble Gaming("the Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Community Guidelines, all of which are incorporated here by reference. If you do not agree to these Terms, you may not access or use the Service.
This is an 18+ platform. By using the Service you confirm you are at least 18 years old.
2. Description of Service
Crit-Fumble Gaming is a gaming platform that provides:
- Game session and campaign management, including world-building tools
- Character sheet creation and tracking
- Discord Activities for voice channel integration
- Multiverse and universe management
- Integration with game systems, VTTs, and other third-party tools
3. Account Registration
You must be 18 years of age or older to use this Service. By registering, you confirm that you meet this requirement. Accounts found to belong to minors will be permanently closed and all data deleted.
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
We do not require your real name.Your display name is a handle or username — use whatever you're comfortable sharing publicly. Real identity information is never required to use the platform.
4. User Content and Ownership
4.1 Your Content Is Yours
You retain full ownership of all content you create on Crit-Fumble Gaming, including game sessions, campaigns, characters, worlds, lore, game systems, compendium entries, asset packs, and any other creative or data works ("User Content"). Crit-Fumble Gaming claims no ownership over your User Content and does not acquire any rights in it beyond those strictly necessary to operate the platform.
4.2 License Grant
By posting User Content, you grant Crit-Fumble Gaming a worldwide, non-exclusive, royalty-free license solely to:
- Store, display, and transmit your User Content to provide the service
- Enable sharing features you choose to use
- Create backups and ensure service functionality
This license does not grant Crit-Fumble Gaming the right to sell, sublicense, or commercially exploit your User Content in any way beyond providing the platform to you.
4.3 Your Licensing Freedom
You are free to license, share, publish, or distribute your User Content under any terms you choose — including open licenses, commercial licenses, or any other arrangement — without restriction or permission from Crit-Fumble Gaming. Your content is yours to do with as you see fit.
4.4 Digital Product Revenue
Any revenue you generate from digital products sold or distributed through the Crit-Fumble Gaming platform belongs entirely to you. Crit-Fumble Gaming does not take a cut of digital product sales. Platform fees (compute, hosting, subscriptions) are separate from and do not apply to revenue you earn from your own content.
4.5 Physical Products
Physical production of your content (printed books, miniatures, dice, and other physical goods) is outside the scope of this agreement and is subject to separate negotiation. Crit-Fumble Gaming may offer prototyping assistance (resin printing, filament printing, book publishing guidance) as a service on mutually agreed terms. Any such arrangement does not affect your ownership of the underlying content.
4.6 Absolute Content Prohibitions
The following content is prohibited under all circumstances, regardless of claimed fictional framing or any other justification:
- Illegal content — any content that is illegal in the jurisdictions where we operate. We remove such content, terminate the account, and report the material to the relevant authorities as required by law. There is no warning for this.
- Nudity and sexually explicit content — Crit-Fumble Gaming is a Safe-for-Work platform. No nudity, no sexually explicit depictions, no matter the framing or artistic intent.
- Non-consensual intimate imagery — sharing or uploading intimate images or depictions of a real person without their explicit consent
- Hate speech — content targeting race, ethnicity, gender identity, sexual orientation, religion, disability, or nationality
- Doxxing— disclosing another person's private or identifying real-world information without their consent
- Pirated material — uploading, sharing, or linking to copyrighted game resources, ROMs, or other content you do not have the right to distribute
- Malware, viruses, or malicious scripts
- Threats, targeted harassment, or content designed to intimidate a specific individual
4.7 Mature Themes, Safe-for-Work Content
Crit-Fumble Gaming is an 18+ platform with a Safe-for-Work content baseline. Strong language, mature themes, and graphic violence within the fiction of a game are fine — we trust adults to handle dark subject matter in storytelling. How your group handles content expectations at the table is up to you. Our Community Guidelines include suggestions if you want them, but we don't dictate how you run your games.
Nudity and sexually explicit content are not permitted regardless of fictional framing or participant agreement. See §4.6 for the full list of prohibited content.
5. File Uploads and Storage
The platform accepts the following types of user-uploaded files:
- Images (avatars, character portraits, session and campaign banners) — JPEG, PNG, WebP, GIF; automatically converted to WebP for storage
- Documents (session notes, handouts) — stored privately; accessible only to you via time-limited links
- ROM files (for digital game integration) — stored privately; you must own or have a legal right to use any ROM you upload
All uploaded content is subject to the prohibitions in §4.6. We reserve the right to remove any uploaded file that violates these Terms. Storage quotas apply per account tier; see your account settings for your current usage.
6. Voice Sessions
Live voice and video for sessions are handled by Discord, not by Crit-Fumble Gaming. We do not proxy or intercept real-time voice traffic.
If a GM enables the optional Voice Recording feature, audio from speakers who opt in is captured by our Discord bot, mixed into a single MP3 file, and stored so participants can download and archive the session. Recordings live with the rest of your session data and can be deleted at any time.
If Transcription is also enabled, the captured audio is additionally streamed to Deepgram for real-time speech-to-text and the resulting transcript text is stored in your session chat history. Deepgram does not retain the streamed audio.
Both features are opt-in per session, require consent from every recorded speaker, and are metered against your Compute Token allowance — see our Privacy Policy for details on how recordings, transcripts, and third-party processors are handled.
- All community conduct rules apply to voice sessions
- When using Discord Activities, you must also comply with Discord's Terms of Service
- We are not responsible for the availability of Discord, Deepgram, or other third-party services
7. Prohibited Uses
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Use automated scripts or bots to access the Service without authorization
- Impersonate any person or entity
- Collect, harvest, or share another user's personal or identifying information without their consent
- Direct hate speech, harassment, or targeted abuse at any person
- Share or promote pirated game resources or copyrighted material you do not have the right to distribute
- Reverse engineer or attempt to extract source code from the Service
8. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned byCrit-Fumble Gaming and are protected by international copyright, trademark, and other intellectual property laws.
Third-party RPG systems, game rules, and trademarks remain the property of their respective owners.
9. Payment and Subscriptions
Certain features require payment. By subscribing to a paid plan:
- Billing. Subscriptions are billed monthly in advance and renew automatically until you cancel. Pricing for each tier is shown on the pricing page.
- Cancellation. You can cancel auto-renewal at any time through your Account → Subscription page (which routes to Stripe's billing portal). Cancellation takes effect at the end of your current billing cycle so you don't lose paid-for time.
- Upgrades and downgrades. Tier upgrades take effect immediately and are pro-rated for the remainder of the cycle. Downgrades take effect at the end of the current cycle.
- Crit-Coins and Compute Tokens are non-refundable. Crit-Coins (CC) and Compute Tokens (CT) are virtual currency used to pay for metered services and tips. Once spent on a service or sent as a tip, they cannot be refunded. Unspent CC and CT remain in your wallet for future use.
- Refunds for billing errors and outages. If you are charged in error, or if a paid feature is unavailable for a material portion of a billing period, message an admin on our Discord server and we will review your case. Beta features have an additional refund policy in §10.
- Pricing changes.We may change subscription pricing with at least 30 days' notice; changes do not take effect mid-cycle on an existing subscription.
10. Beta Features
Some features are explicitly marked as Beta. Beta features work, but they are less battle-tested than the rest of the platform: they may have bugs, may have brief downtime, and their behavior may change as we refine them. We label every Beta feature clearly in the product and on the pricing page.
Features covered by this Beta clause (i.e. eligible for the prorated refund described below):
- App hosting — managed container instances, session launching, and platform plugin bridges.
- Live transcription — Discord-bot voice capture, Deepgram speech-to-text, and the resulting session-chat transcript.
Refund policy for Beta features. If a Beta feature listed above is unavailable for a material portion of a billing period (for example, more than 24 hours of cumulative downtime in a month), contact support and we will consider a prorated refund for the affected feature. We do not issue full subscription refunds because of a Beta-feature outage — the rest of your plan continues to work. Ordinary refund policy (§9) covers the non-Beta portions of your subscription.
As Beta features mature, this list shrinks. Bugs are triaged on the community Discord, and we note in our release channels when a feature leaves Beta.
11. Enforcement and Termination
Violations of these Terms or the Community Guidelines are handled in proportion to their severity:
- Warning — for minor or first-time violations
- Removal from a game session— at the GM's or an admin's discretion
- Temporary suspension — for repeated violations or more serious conduct
- Permanent ban — for egregious violations including hate speech, doxxing, harassment, piracy, or any conduct involving minors
We may also suspend or terminate accounts if required by law or a valid legal request. When an account is terminated for conduct violations, we may retain a minimal record of the violation and ban for platform safety purposes.
You may terminate your own account at any time through your Account → Privacy & Data settings.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRIT-FUMBLE GAMING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
14. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.
15. Community Standards
Use of the Service is subject to our Community Guidelines, which are incorporated into these Terms by reference. The Community Guidelines are suggestions for healthy tables and platform-wide spaces; the enforceable prohibitions are the ones listed in §4.6 and §7.
Violations of §4.6 or §7 are violations of these Terms and are subject to the enforcement process described in Section 11.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms and updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in whichCrit-Fumble Gaming operates, without regard to its conflict of law provisions.
